Youngstown's Roberto's restaurant closed by tax commissioner

A popular restaurant on Federal Street in downtown Youngstown is closed temporarily. 

When the staff of Roberto's Italian Ristorante came to work Wednesday, they were surprised by a notice from the tax commissioner. 

John Naples, Roberto's co-owner, tells 21 News the notice informed them that they would not be allowed to sell anything retail. 

Naples tells 21 News the reason for the unexpected closure was a misunderstanding over a due date for back taxes. 

Naples was under the impression that the business had until February 1 to pay the taxes and was planning on doing so, and was surprised to find he could not open his business today. 

Gary Gudmundson with the Ohio Department of Taxation said that the situation with Roberto's is a sales tax issue.

He said the restaurant is behind on their sales tax payments and that when you sit down and eat at a restaurant, you are taxed, however, carry-out food is not taxed.

The owners have contacted their attorney and hope to be open for business again in a day or two.
